1. Acceptance of terms

Welcome to MiPodio ("MiPodio", the "Service", the "App", "we", "us"), operated by BeaverCode (the "Operator"). These Terms of Service ("Terms") govern your access to and use of the website and progressive web application (PWA) available at mipodio.com and its subdomains.

By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

2. Description of the service

MiPodio is a free, social sports prediction web application (football/soccer and other sports). Users can create or join prediction groups (also called "pools", "pollas", "quinielas", or "prodes"), predict the results of matches, earn points based on the accuracy of their predictions, and compete on a live leaderboard with friends and other participants.

3. NOT a betting or real-money gambling service

MiPodio is a free, social prediction game. It is NOT a betting, casino, sportsbook, or real-money gambling service.

  • The Service does not accept, process, hold, or distribute money, wagers, or cash prizes as part of its operation.
  • Points, standings, rankings, and any scoring elements are purely recreational and for entertainment, and have no monetary value and cannot be exchanged for money.
  • We do not guarantee or promote any form of real-money betting.

If any group of users decides, on their own and outside the platform, to associate money or prizes with their predictions, they do so at their sole responsibility and without any involvement, endorsement, knowledge, or liability of the Operator. The Operator is not a party to and does not facilitate such arrangements.

4. Eligibility and age

To use the Service you must be at least 18 years old, or the age of legal majority in your jurisdiction, whichever is greater. The Service is not directed to children under the stated age. If you are a minor under applicable law, you may only use the Service with the consent and supervision of a parent or legal guardian.

By using the Service, you represent and warrant that you meet the age requirements and have the legal capacity to accept these Terms.

5. Accounts and user responsibilities

  • To access certain features you must create an account using email and password, or via Google Sign-In.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
  • You must provide truthful, accurate, and up-to-date information when registering.
  • You must notify us immediately of any unauthorized use of your account or any other security breach.
  • You may not share, transfer, or sell your account to third parties.

6. Acceptable use and prohibited conduct

When using the Service, you agree NOT to:

  • Violate any applicable law or regulation.
  • Impersonate any person or entity, or misrepresent your affiliation.
  • Access other users' accounts without authorization.
  • Use bots, scripts, scraping, or any automated means to access the Service or manipulate predictions, scores, or rankings.
  • Attempt to breach, overload, or interfere with the security, integrity, or performance of the Service.
  • Post or transmit unlawful, defamatory, obscene, offensive, discriminatory, or harassing content, or content that infringes the rights of others.
  • Use the Service to send spam, unsolicited advertising, or fraudulent schemes.
  • Use the Service to organize or facilitate real-money betting.
  • Reverse engineer, decompile, or attempt to extract the source code of the Service, except as permitted by law.

We reserve the right to investigate and take appropriate action, including suspending or removing accounts, for any violation.

7. User content (predictions and activity)

The Service allows you to generate content, primarily your predictions, group names, display name, and similar items ("User Content").

  • You retain ownership of your User Content.
  • By submitting User Content, you grant the Operator a worldwide, non-exclusive, royalty-free, transferable license to host, store, reproduce, display, and use that content solely to operate, maintain, and improve the Service (for example, showing your predictions and your leaderboard position to other participants in your group).
  • You are solely responsible for your User Content and for ensuring it does not infringe third-party rights or these Terms.

8. Intellectual property

The Service, including its software, design, brand, logos, text, graphics, and interfaces (excluding User Content), is owned by the Operator or its licensors and is protected by intellectual property laws. You are granted no rights to these elements other than the limited license to use the Service under these Terms.

"MiPodio" and associated logos are trademarks of the Operator. You may not use them without prior written authorization.

9. Third-party services

The Service relies on external providers to function, including:

  • Google — for sign-in (OAuth) and anti-bot protection (reCAPTCHA).
  • Cloudflare — for content delivery, security, and network protection.
  • Transactional email provider (Brevo) — for sending account-related emails.

Use of these services may be subject to their own terms and privacy policies. The Operator is not responsible for third-party practices. See our Privacy Policy for more details.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, UNINTERRUPTED AVAILABILITY, OR ERROR-FREE OPERATION.

We do not warrant that the Service will be free of faults, interruptions, or inaccuracies, or that match results, point calculations, or rankings will always be accurate or available on time.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE OPERATOR AND ITS CONTRIBUTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, NOR FOR LOSS OF DATA, USE, GOODWILL, OR PROFITS, ARISING OUT OF OR RELATED TO THE USE OF OR INABILITY TO USE THE SERVICE.

Because the Service is free, the Operator's total liability for any claim relating to the Service shall not exceed USD 100 (or the minimum permitted by applicable law).

Some jurisdictions do not allow certain exclusions or limitations; in such cases, these limitations shall apply to the maximum extent permitted.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service, with or without notice, if you breach these Terms, if your conduct may cause harm to the Service or other users, or as required by law.

Upon termination, provisions that by their nature should survive (such as intellectual property, disclaimers, and limitation of liability) will remain in effect.

13. Changes to the terms

We may modify these Terms at any time. When we do, we will update the "Last updated" date and, when changes are material, will make reasonable efforts to notify you. Your continued use of the Service after the changes take effect constitutes your acceptance of them.

14. Governing law and jurisdiction

These Terms are governed by the laws of Colombia, without giving effect to its conflict-of-laws rules. Any dispute relating to these Terms or the Service shall be submitted to the competent courts of Colombia, unless applicable law provides otherwise.
